These Terms & Conditions (“Terms”) govern your use of the Counting Sheep Club mobile application and related services (“Service”).

Counting Sheep Club is operated in Belgium (“we”, “us”, “our”).

By downloading, accessing, or using the Service, you agree to these Terms.

If you do not agree, please do not use the Service.


1. Eligibility

The Service is intended exclusively for parents or legal guardians.

By using the Service, you confirm that:

  • You are at least 18 years old, and

  • You are using the Service on behalf of your child under your supervision.

Children may not create accounts or use the Service independently.


2. The Service

Counting Sheep Club provides AI-generated bedtime stories and audio experiences designed to support calm and emotionally safe bedtime routines.

We currently offer:

  • Access to 3 free stories

  • Paid monthly and yearly subscriptions for full access

We may update, improve, or modify features at any time.


3. Accounts

To access subscription features, you may be required to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activity under your account

Stories may be saved within your account for personal use. Stories cannot be shared, redistributed, or commercially exploited.

We reserve the right to suspend or terminate accounts that violate these Terms.


4. Subscriptions & Payments

Subscription Plans

We offer:

  • Monthly subscription

  • Yearly subscription

Pricing is displayed in the app and may vary by region.


Billing

  • Payments are processed through the Apple App Store or Google Play Store.

  • Payment is charged to your store account upon confirmation of purchase.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.


Managing or Cancelling Subscriptions

You may manage or cancel your subscription through your Apple or Google account settings.


Refunds

All billing, cancellations, and refunds are handled by Apple or Google according to their respective policies. We do not process refunds directly.


5. Free Stories

We provide access to 3 free stories without requiring a subscription. Access to additional stories requires an active subscription. We reserve the right to modify or discontinue free access at any time.


6. Intellectual Property

All content within the Service — including but not limited to:

  • Stories

  • Audio recordings

  • Design elements

  • Branding

  • Software and technology

is owned by Counting Sheep Club or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

You may not:

  • Reproduce

  • Distribute

  • Modify

  • Reverse engineer

  • Commercially exploit

any part of the Service without prior written consent.


7. AI-Generated Content

Stories are generated using artificial intelligence.

While we strive to ensure that all content is appropriate and safe for children:

  • Content is generated dynamically.

  • Parents remain responsible for supervising their child’s use of the Service.

We do not guarantee that all content will align with personal preferences.


8. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes

  • Attempt to disrupt or interfere with the Service

  • Reverse engineer or attempt to access underlying systems

  • Circumvent subscription mechanisms

Violation may result in account suspension or termination.


9. Privacy

Your use of the Service is governed by our Privacy Policy:

10. Limitation of Liability

To the maximum extent permitted under applicable law:

  • The Service is provided “as is” and “as available”.

  • We do not guarantee uninterrupted or error-free operation.

  • Our total liability shall not exceed the amount paid by you for the Service during the previous 12 months.

Nothing in these Terms excludes liability where exclusion is not permitted by Belgian or EU law.


11. Changes to the Service or Terms

We may update these Terms from time to time. If changes are material, we will notify users within the app or by other reasonable means. Continued use of the Service after changes constitutes acceptance.


12. Governing Law

These Terms are governed by the laws of Belgium.

Any disputes shall be subject to the competent courts of Belgium.


13. Apple App Store Notice

If you access the Service via iOS:

  • These Terms are between you and Counting Sheep Club, not Apple Inc.

  • Apple has no obligation to provide maintenance or support services.

  • Apple is not responsible for addressing any claims relating to the Service.
